2.20.    As outlined within our Privacy Policy, we may engage in direct marketing and lead sourcing by collecting publicly-available personally identifying data, and temporarily storing it for the sole and exclusive purpose of engaging in direct marketing, and reaching out to those leads (personally or via a software program) to offer free services, information on our goods and services, partnership opportunities, or other similar reasons. You understand and agree that by using Website, we may use any contact information provided as a direct or indirect of your use of our Website, in order to contact you regarding our services and your potential interest. You may elect not to be contacted and request that all such information we have collected about you is removed from our database, and we will permanently remove and not contact you again.

3.1      In the event of disputes resulting from the use of our Services, the parties will first consult together with a view to resolve the dispute amicably.

3.2     If the parties are unable to resolve a dispute amicably, it will be referred to the Superior court in King County, Washington.

3.3     Your use of our Services and any dispute arising out of such use of the Website is subject to the laws of King County, Washington, United States of America and applicable federal law without regard to conflicts of laws principles.

Section IV - Copyright Complaints. (DMCA Takedown Requests)

4.1       Pursuant to Title 17, United States Code, Section 512(c)(2), notifications of claimed copyright infringement must be sent to Service Provider’s Designated Agent.

4.2       To be effective, the notification must be a written communication that includes the following:

4.3       Natalie Swan LLC. may give notice of a claim of copyright infringement to our users by means of a general notice on the Website, electronic mail to a user’s e-mail address in our records, or by written communication sent by first-class mail to a user’s address in our records. Valkyrie, LLC, may, within its sole discretion, terminate authorization of users of its Services who are repeat infringers.

Section V – Governing Law, Disclaimer, and Limitation of Liability

5.1  This Agreement shall be construed and enforced in accordance with the laws of the State of Washington, without effect to the State’s choice or conflicts of law provisions. In the event any dispute arises out of or relating to this Agreement results in litigation, the Parties agree that the same shall be heard in a state or federal court having subject matter jurisdiction seated in King County, Washington, and the Parties submit to personal jurisdiction of such court and agree that venue shall properly lie therein.

5.2  LIMITED LIABILITY. We shall not be liable for any failure of the Services, or any delay in the availability thereof. We shall not be liable for any loss, damage, liability, cost or expense incurred by You arising from any interruption in internet access, no matter the cause. WE MAKES NO REPRESENTATIONS OR WARRANTIES WHATSOEVER, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY REPRESENTATION OR WARRANTY WITH RESPECT TO THE DESIGN, COMPLIANCE WITH SPECIFICATIONS, ACCURACY OF DATA, QUALITY, OPERATION, THE MERCHANTABILITY OR FITNESS OF THE PRODUCTS AND SERVICES FOR A PARTICULAR PURPOSE, OR ISSUES REGARDING IP RIGHTS INFRINGEMENT, OR TITLE. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, EXEMPLARY, SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, BUSINESS INTERRUPTION, LOST BUSINESS INFORMATION OR COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, EVEN IF WE KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE FORM OF ACTION OR THEORY OF LIABILITY. OUR CUMULATIVE LIABILITY TO YOU, FROM ALL CAUSES OF ACTION AND ALL THEORIES OF LIABILITY, WILL BE LIMITED TO AND SHALL NOT EXCEED THE FEES ACTUALLY PAID BY YOU TO US FOR THE LICENSED SOFTWARE, PRODUCTS, OR SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE DATE ON WHICH THE CLAIM AROSE. THE FOREGOING LIMITATIONS SHALL APPLY NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. The parties acknowledge that the limitations set forth in this Section are integral to the fees charged for access to the Licensed Software, Products and Services and that, were We to assume any further liability other than as set forth herein, such fees would of necessity be set substantially higher.
